Terms of Sale

Terms governing the purchase and delivery of digital products and digital services on MBcare websites.

These Terms of Sale govern the purchase of digital products and digital services offered by MBCare LLC through www.mbcare.ru, mbcare.ru, and related websites, pages, and checkout flows.

By placing an order, you agree to these Terms of Sale. If you do not agree, please do not purchase or use our products or services.

2. Products and services

We sell digital products and digital services only. We do not sell physical goods.

Depending on the product, the purchase may include one or more of the following:

  • Access for a defined time period, such as one hour, one day, one month, or one year
  • Digital files, instructions, generated data, or account-linked access
  • Manual or semi-manual fulfillment based on vehicle, VIN, device, or account information provided by the customer

3. Ordering process

Before placing an order, please review the product description carefully. You are responsible for ensuring that the product you select matches your intended use.

Some products may require additional information before delivery or activation, such as:

  • VIN
  • Vehicle model and year
  • Photos or screenshots
  • Software, diagnostics, or system information
  • Email address or account information

If required information is missing, inaccurate, or incomplete, fulfillment may be delayed or may not be possible.

4. Pricing and payment

All prices are displayed on the relevant product page or checkout page. Prices may be shown in USD or another stated currency.

Payment must be completed successfully before delivery, activation, access, or fulfillment begins, unless explicitly agreed otherwise.

Payments are processed by third-party payment providers, including Stripe where available.

We reserve the right to correct obvious pricing errors, technical errors, or product configuration errors before fulfilling an order.

5. Delivery of digital products and services

Because our products are digital, delivery may take one of several forms:

  • Immediate automatic access after payment
  • Time-limited access activated after checkout
  • Manual delivery by email, website, account update, or support contact
  • Delivery after compatibility review or receipt of the required information

Estimated delivery times may be shown on the product page or communicated separately. Some services are performed manually and may require additional time.

6. Compatibility and customer responsibility

Many of our digital products and services depend on the exact technical configuration of the customer’s system, vehicle, hardware, software version, account status, or region.

You are responsible for providing accurate information. If a product requires compatibility verification, you must provide correct and complete technical details.

  • Not all features are available on all vehicles, devices, or software versions
  • Results may vary depending on model, production year, installed hardware, coding status, and current software
  • Incorrect VIN, screenshots, software details, or account data may prevent delivery or activation

7. License and permitted use

Unless otherwise stated, products are sold for the customer’s own lawful use and only within the scope described on the product page or order confirmation.

You may not:

  • Resell, redistribute, sublicense, or share purchased access unless a reseller product explicitly allows it
  • Reverse engineer, copy, or misuse digital content where prohibited by law or by the specific product terms
  • Use the product in a fraudulent, unlawful, abusive, or unauthorized way

We may suspend or refuse service in case of abuse, fraud, chargeback abuse, or unlawful use.

8. Refunds and cancellations

Refunds, cancellations, and any right of withdrawal are governed by our separate Refund / Cancellation Policy.

For digital products and digital services, refund eligibility may depend on whether delivery has started, access has been granted, a file has been generated, a service has been performed, or customer-specific work has already begun.

9. Service availability

We aim to keep our websites, digital products, and support channels available, but uninterrupted operation cannot be guaranteed at all times.

Temporary downtime may occur due to maintenance, technical failures, provider outages, security measures, or reasons outside our control.

10. Disclaimers

To the maximum extent permitted by law, digital products and services are provided on an “as is” and “as available” basis, except where mandatory consumer law provides otherwise.

We do not guarantee that every product or feature will be compatible with every system, vehicle, device, region, or software version unless explicitly stated.

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of business, loss of data, loss of access, or downtime arising from the purchase or use of our products or services.

Nothing in these Terms excludes liability that cannot legally be excluded under applicable consumer law.

12. Chargebacks and fraud prevention

We reserve the right to review orders for fraud prevention and identity verification purposes.

If a payment is reversed through an unjustified chargeback or payment dispute after delivery, access may be suspended and we may contest the dispute using order, delivery, technical, and communication records.

13. Consumer rights

If you are a consumer in the European Economic Area, the United Kingdom, or another jurisdiction with mandatory consumer protections, nothing in these Terms of Sale limits rights that cannot legally be waived.

Where required by law, pre-contract information, withdrawal information, and refund rules are provided separately or within the checkout process.

14. Changes to these terms

We may update these Terms of Sale from time to time. The updated version will be posted on this page with a revised Last updated date.

The version in effect at the time of purchase generally applies to that purchase unless mandatory law requires otherwise.
